These Terms of Service (Terms) govern your access to and use of Kach. By creating an account or using Kach, you agree to these Terms, the Community Rules, and the Privacy Policy.

If you do not agree, do not create an account or use Kach.

Eligibility

You must be at least 18 years old and legally able to agree to these Terms. You must provide accurate account information and must not use Kach if your account is suspended or banned.

You are responsible for activity on your account and for keeping access to your device and account secure. Tell us promptly at conxconx199@gmail.com if you suspect unauthorized access.

What Kach provides

Kach is a platform that helps users offer and request lawful physical items for free. Kach:

• does not sell the listed items;
• does not process payments, deposits, delivery charges, or escrow;
• is not a party to arrangements between a giver and a taker;
• does not take possession of, inspect, authenticate, deliver, insure, or guarantee an item; and
• does not guarantee that a listing, user, message, location, or review is accurate or safe.

Do not request or send payment through a Kach giveaway. Report any user who asks for money.

Your listings and content

You keep ownership of content you create. You grant Kach a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, display, translate, analyze, and distribute that content only as reasonably needed to operate, secure, moderate, and improve Kach and to display the content to intended users.

You represent that you have the necessary rights to submit the content and offer the item. You must describe items honestly, use your own photos or photos you are allowed to use, disclose material defects, and remove or update unavailable listings.

Do not publish private addresses, identification numbers, financial details, passwords, or another person’s private information. Listing locations are approximate; share a final meeting point privately only when appropriate.

Safety and lawful exchanges

You are responsible for deciding whether an item and exchange are lawful, appropriate, and safe. Before accepting an item, inspect it and consider any health, safety, recall, electrical, age, installation, or transport risks.

For in-person exchanges, consider a public place, daylight hours, telling someone where you are going, and ending the meeting if you feel unsafe. Never enter a situation merely because another Kach user requested it. Contact local emergency services when there is an immediate danger.

Prohibited conduct and items

You must follow the Community Rules. Among other things, Kach prohibits harassment, threats, hate, scams, sexual exploitation, illegal activity, and attempts to evade safety systems.

Kach does not allow firearms, ammunition, explosives, illegal weapons, illegal drugs or controlled substances, tobacco, vapes, nicotine products, alcohol, consumable medicines, or any item whose transfer is illegal. Accessibility and non-consumable medical equipment are allowed when lawful. Ordinary household tools, including kitchen knives, are allowed unless marketed or offered as weapons.

Messages, reservations, and reviews

Use messages only for legitimate communication related to Kach and lawful giveaways. A reservation is a coordination feature, not a legally guaranteed transfer. Either participant may end an arrangement subject to honest and non-abusive conduct.

Reviews must describe a genuine Kach interaction. Do not manipulate ratings, trade reviews, impersonate another person, or use reviews to threaten or disclose private information.

Moderation and enforcement

Kach may use automated systems, including OpenAI moderation, and human review to detect unsafe, prohibited, or unlawful text and images. By accepting these Terms, you authorize Kach to send listing text and photos to OpenAI solely for automated safety classification. Automated systems can make mistakes.

We may reject, hide, limit, or remove content; restrict messages or features; issue warnings; suspend or ban accounts; preserve information needed for an investigation; or report conduct where reasonably necessary for safety or legal compliance. Enforcement may consider context, severity, history, and credible reports.

You can report content or users inside Kach, block users, or contact conxconx199@gmail.com. If you believe an action was mistaken, contact support with the account email and relevant details.

Privacy

Kach handles information as described in the Privacy Policy. Do not access, collect, scrape, sell, or misuse another user’s information.

Availability and changes

We may change, suspend, or discontinue features to maintain security, comply with law, or improve Kach. We may update these Terms. When a material change requires renewed acceptance, Kach may ask you to accept the updated version before continuing to submit content.

Account termination

You may permanently delete your account as described on the Account Deletion page. We may restrict or terminate accounts that violate these Terms or create a safety, legal, or security risk.

Sections that by their nature should survive account closure—including content licenses needed for limited retained records, safety enforcement, dispute terms, and legal obligations—continue only to that extent.

Disclaimers and responsibility

Kach is provided on an “as available” basis. To the extent permitted by applicable law, Kach disclaims warranties that the service will always be uninterrupted, error-free, or that every user or item is safe or accurately described.

You remain responsible for your content, conduct, legal compliance, and exchanges with other users. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded, including mandatory consumer rights that apply to you.
